These Terms of Use (“Terms”) govern your access to and use of the Solar Flex website, services, and communications (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.
Solar Flex, LLC (“Solar Flex,” “we,” “us,” or “our”) operates as an independent solar referral and lead generation service. Solar Flex is not a solar installer, contractor, financing company, or utility provider. We do not perform installation or construction services.
1. About Solar Flex
Solar Flex connects consumers with third-party solar energy providers, installers, EPCs, sales organizations, financing partners, and related industry service providers (collectively, “Providers”). Providers vary by location, credit qualification, utility service territory, roof/building design, and project type.
Solar Flex does not:
• Perform site assessments, engineering, permitting, installation, or servicing.
• Make performance or savings guarantees.
• Provide legal, tax, structural, financial, or engineering advice.
• Control pricing, terms, workmanship, timelines, incentives, warranties, or contract details offered by Providers.
• Any contract for goods, financing, warranties, installation, or maintenance is solely between you and the Provider.
2. No Endorsement or Warranty of Providers
We do not warrant, endorse, guarantee, or evaluate:
• The qualifications or background of any Provider.
• The accuracy of representations made by Providers.
• System quality, performance, output, or projected utility savings.
• Eligibility for federal, state, or utility incentives or tax credits.
• Contract terms or financing products offered by Providers.
You are solely responsible for evaluating any Provider before entering into an agreement. We strongly recommend obtaining multiple quotes and reviewing contract terms carefully.
3. Estimations, Savings, Incentives, and Tax Disclosures
Solar energy projections depend on utility rates, system design, weather, maintenance, occupancy, government programs, and future policy changes.
Therefore:
• Savings are not guaranteed.
• Tax credits and incentives may change or may not apply to your situation.
• Utility net metering policies may change.
You should consult your own tax advisor, financial advisor, or legal counsel before making any solar installation or financing decisions.
4. User Information and Lead Routing
By submitting your information on our website or through any of our forms, landing pages, advertisements, or phone interactions, you authorize Solar Flex to share your information with one or more Providers for the purpose of receiving quotes, proposals, follow-up, or marketing related to solar services.
Information you provide may include:
• Name
• Phone number
• Address and property details
• Utility information
• Energy usage details (if provided)
We may also use verification and consent-tracking technologies, including but not limited to ActiveProspect TrustedForm and Jornaya LeadiD, to document that you provided consent to be contacted.

5. SMS/Text Messaging Consent (TCPA Compliance)
By providing your phone number, you consent to receive recurring SMS/text messages and calls from Solar Flex and Providers using automated technology for service updates, quotes, scheduling, and promotional purposes.
You understand that:
• Consent is not a condition of purchase.
• Message and data rates may apply.
• Message frequency varies.
To opt out, reply STOP to any message.
To request help, reply HELP.
6. Use of the Website
You may use the Services for personal, non-commercial purposes only.
You may not:
• Access the Services using automated tools or scraping technologies.
• Reverse engineer, copy, resell, or commercially exploit any part of the Services.
• Interfere with system integrity, security, or availability.
7. Intellectual Property
All content on the Services, including branding, design, graphics, and text, is owned by or licensed to Solar Flex and is protected by law. You may not copy or use it without permission.
8. Links to Third-Party Websites
The Services may contain links to third-party websites. Solar Flex is not responsible for the content, policies, or practices of those third parties.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SOLAR FLEX DISCLAIMS ALL WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, SYSTEM PERFORMANCE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
SOLAR FLEX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR RELIANCE DAMAGES, INCLUDING LOST PROFITS OR LOST SAVINGS.
Solar Flex’s maximum aggregate liability to you for use of the Services is $0, as the Services are provided at no cost.
11. Indemnification
You agree to indemnify and hold harmless Solar Flex from any claims, disputes, liabilities, and expenses arising from:
Your use of the Services,
Your interactions or agreements with Providers,
Your breach of these Terms.
12. Arbitration Agreement (Binding, Individual Only)
Any dispute between you and Solar Flex will be resolved through individual binding arbitration under the Federal Arbitration Act. No class or representative
claims are permitted.

Administrator: American Arbitration Association (AAA)
If you do not agree to this section, do not use our Services.
13. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules.
14. Updates to Terms
We may update these Terms at any time. Updates are effective when posted. Continued use of the Services constitutes acceptance of the changes.
